Terms and conditions for the online sale of tickets for events at Music Café and Bookstore of PWM Edition

1. Definitions

1.1. "Punkt Wydawania Muzyki" – Punkt Wydawania Muzyki Sp. z o.o., with its registered office in Kraków, ul. Pawia 34/47, 31-154 Kraków, Poland, Tax Identification Number (NIP): 5732856051, National Court Register (KRS): 0000572965, Statistical Business Number (REGON): 362328993

1.2. "Terms and Conditions" – these Terms and Conditions governing the online sale of tickets for events held at UNA Club Bookstore.

1.3. "System" – the VisualTicket ticket sales system available through the Website.

1.4. "Website" – the website at https://una-krakow.pl, through which Tickets are sold via the System.

1.5. "Purchaser" – any entity using the System, including a natural person (i.a. a consumer), a legal entity, or any other organisational unit purchasing Tickets.

1.6. "Event Ticket" or – an admission ticket entitling the holder to attend an event at UNA Club Bookstore, purchased through the System.

1.7. "Payment Platform" – the online payment service operated by Przelewy24, provided by PayPro S.A., with its registered office in Poznań, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0000347935, maintained by the District Court Poznań–Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, Tax Identification Number (NIP): 7792369887, REGON: 301345068, with a share capital of PLN 5,476,300.00, fully paid up, and entered in the Register of National Payment Institutions maintained by the Polish Financial Supervision Authority (Komisja Nadzoru Finansowego) under number IP24/2014.

2. General provisions

2.1. These Terms and Conditions govern the online sale of Event Tickets by Punkt Wydawania Muzyki through the System.

2.2. Purchasing a Ticket through the System is conditional upon the Purchaser reading and accepting these Terms and Conditions.

2.3. The Purchaser shall use the System in accordance with these Terms and Conditions and the applicable provisions of law.

2.4. The minimum technical requirements necessary to use the System are:

  • a computer or other mobile device with an internet browser and Internet access;
  • an active e-mail account;
  • a bank account with online banking access.

3. Placing an order

3.1. An order is placed by completing the following steps in the System by the Purchaser:

  • selecting the date, time and title of the event to be attended, as well as the type and number of Tickets;
  • correctly completing all mandatory fields of the order form;
  • accepting these Terms and Conditions and, where applicable, the rules governing participation in the selected event;
  • submitting the order by clicking the appropriate button in the System;
  • proceeding to the Payment Platform.

3.2. Upon placing an order, the Purchaser will receive an e-mail confirming that the order has been accepted for processing.

3.3. Punkt Wydawania Muzyki reserves the right to impose a limit on the number of Tickets that may be purchased in a single order.

3.4. Punkt Wydawania Muzyki shall not be liable for any consequences resulting from the Purchaser providing false or incorrect information in the order form.

4. Payment and order fulfilment

4.1. The Purchaser shall pay for the order within three (3) hours of receiving the confirmation that the order has been accepted for processing. Failure to make payment within this period shall result in the automatic cancellation of the order.

4.2. If the order is cancelled, the Purchaser will automatically receive an e-mail confirming the cancellation.

4.3. Payment for Tickets shall be made via the Payment Platform.

4.4. Punkt Wydawania Muzyki shall not be liable for any consequences arising from malfunctions or irregularities in the operation of the Przelewy24 payment system operated by PayPro S.A. or the bank selected by the Purchaser during the payment process.

4.5. Upon the Purchaser's request, Punkt Wydawania Muzyki shall issue a VAT invoice. Such a request must be made by the Purchaser, and invoices are issued only after payment has been received.

4.6. Punkt Wydawania Muzyki shall not be liable for any consequences arising from the Purchaser providing false or incorrect information required for issuing a VAT invoice.

4.7. The order shall be processed upon receipt of payment confirmation from the Przelewy24 payment system.

4.8. Receipt of payment and completion of the order shall be confirmed automatically by an automatically generated e-mail will be sent by the System to the Purchaser's e-mail address, containing the purchased Tickets in PDF format.

4.9. The Purchaser shall bear any costs related to accessing their e-mail account in accordance with the applicable tariff of their telecommunications service provider.

4.10. If the Purchaser makes a Ticket available to a third party, there is a risk that the Ticket may be used by that person. In such a case, Punkt Wydawania Muzyki will honour only the Ticket presented by the first person to use it for admission.

4.11. Punkt Wydawania Muzyki shall not be liable for deleted or undelivered notifications sent to the Purchaser.

4.12. Punkt Wydawania Muzyki does not issue paper Tickets. Tickets are issued exclusively in electronic form and sent to the Purchaser's e-mail address after the purchase has been completed.

4.13. The online sale of Tickets, including ordering and payment, is subject to fiscal recording in accordance with applicable law. Accordingly, the Purchaser shall receive proof of payment in electronic form.

5. Tickets

5.1. Ticket prices are specified in the description of each event available at www.una-krakow.pl. Information regarding available concessions or discounted Tickets is published with the description of each event.

5.2. All Ticket prices are stated in Polish zloty (PLN) and include VAT.

5.3. If Tickets for an event are unavailable through the System, this does not necessarily mean that Tickets are unavailable at the UNA box office.

5.4. Each Ticket specifies its validity period, understood as the date and time of admission to the relevant event.

5.5. The Purchaser may either print the Ticket or present it electronically on a mobile device when entering the event.

5.6. Persons holding discounted Tickets shall, upon entry, present both the Ticket and a valid document confirming their entitlement to the discount, in accordance with Section 5.8.

5.7. Discounted Tickets presented without a valid document confirming eligibility for the discount shall not be honoured and are non-refundable.

5.8. Discounted Tickets are available to pupils, students, pensioners and disability pension recipients upon presentation of a valid supporting document.

6. Liability

6.1. Punkt Wydawania Muzyki shall not be liable for any disruption in data transmission during the purchase process, interruptions, or errors in the operation of the System resulting from circumstances beyond its control.

6.2. Punkt Wydawania Muzyki shall not be liable for messages or data lost or unavailable on the Internet due to circumstances beyond its control.

7. Information clause on the processing of personal data

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, "GDPR"), you are hereby informed that:

i. Data Controller: The controller of personal data processed in connection with the sale of Tickets is Punkt Wydawania Muzyki Sp. z o.o., with its registered office in Kraków, ul. Pawia 34/47, 31-154 Kraków, Poland; Tax Identification Number (NIP): 5732856051, National Court Register (KRS): 0000572965, Statistical Business Number (REGON): 362328993

iii. Purposes and Legal Bases for Processing Personal Data: Your personal data are processed for the following purposes:

  • to process the reservation and purchase of an electronic Ticket for an event – legal basis: Article 6(1)(b) GDPR (performance of a contract);
  • to comply with legal obligations incumbent upon the Data Controller (including accounting and tax obligations) – legal basis: Article 6(1)(c) GDPR;
  • to establish, pursue or defend legal claims based on the legitimate interests of the Data Controller – legal basis: Article 6(1)(f) GDPR.

iv. Recipients of Personal Data: Personal data will be disclosed only to entities authorised to receive such data under applicable law.

v. Data Retention Period: Personal data will be processed for the period necessary to perform the contract and, thereafter, for the period required by applicable law or necessary to establish, pursue or defend legal claims, and only to the extent required by law.

vi. Rights of Data Subjects: You have the right to:

  • access your personal data and request their rectification in accordance with Articles 15 and 16 GDPR;
  • request the erasure of your personal data ("right to be forgotten") in accordance with Article 17 GDPR;
  • request restriction of the processing of your personal data in accordance with Article 18 GDPR;
  • data portability in accordance with Article 20 GDPR;
  • object to the processing of your personal data in accordance with Article 21 GDPR;
  • lodge a complaint with the competent supervisory authority responsible for personal data protection, namely the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland, if you believe that the processing of your personal data infringes the GDPR.

vii. Additional Information: Providing personal data is voluntary; however, failure to provide the required data will make it impossible to purchase an Event Ticket. Personal data will not be used for automated decision-making, including profiling.

8. Complaints

8.1. Any questions, comments or complaints regarding the purchase or use of Tickets should be submitted by e-mail to kawiarnia_una@punktwydawaniamuzyki.pl or by telephone at +48 530 901 700.

8.2. Complaints should be submitted without undue delay. A complaint should include:

  • the order number to which the complaint relates;
  • the reason for the complaint together with a description of the circumstances giving rise to it;
  • the complainant's full name or company name and the name of the contact person;
  • the e-mail address;
  • the telephone number.

8.3. Complaints shall be considered by Punkt Wydawania Muzyki within 14 days of their receipt. If Punkt Wydawania Muzyki determines that the complaint concerns circumstances for which another entity may be responsible (in particular the payment system operator or another service provider involved in the performance of the service), it shall, where possible, forward the complaint to the competent entity or inform the Purchaser which entity is responsible for handling it. The Purchaser shall be informed of the outcome by e-mail.

8.4. If the information provided in the complaint is incomplete or requires clarification, Punkt Wydawania Muzyki shall request that the complainant supplement the necessary information before the complaint is examined. The complaint shall be deemed submitted on the date on which all required information has been provided. Failure to provide the requested information shall result in the complaint not being processed.

9. Returns

9.1. Pursuant to Article 38(12) of the Act of 30 May 2014 on Consumer Rights, the Buyer shall not have the right to withdraw from the ticket sales agreement, as it concerns the provision of services related to cultural events where a specific date or period for the provision of the service has been specified.

10. Final provisions

10.1. Punkt Wydawania Muzyki reserves the right to determine, at its sole discretion, the opening and closing dates of online Ticket sales.

10.2. Punkt Wydawania Muzyki reserves the right to suspend online Ticket sales at any time due to unforeseen circumstances or technical reasons.

10.3. Punkt Wydawania Muzyki reserves the right to cancel an on-site Event or an online Event. In such cases, the Buyer shall be entitled to a refund of the amount paid for the purchased Tickets. The refund shall be made by bank transfer to the account designated by the Buyer.

10.4. Punkt Wydawania Muzyki reserves the right to amend these Terms and Conditions.

10.5. These Terms and Conditions have been prepared in two language versions: Polish and English. In the event of any discrepancy between the language versions, the Polish version shall prevail.

10.7. These Terms and Conditions shall enter into force on 18 August 2026.
